At TS Home Inmobiliaria, we are committed to providing a transparent, honest, and secure service, ensuring compliance with all applicable laws and regulations in Spain. Our priority is to protect the rights of our clients, as well as to ensure compliance with the applicable regulations in all our operations.
1. **Transparency and Truthfulness of Information** In accordance with Ley 34/1988, of 11 November, General Advertising Law, we are obliged to provide truthful and non-misleading information in all our communications, advertisements, and publications.
2. **Protection of Personal Data** In compliance with Regulation (EU) 2016/679 (GDPR) and Ley Orgánica 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), we guarantee the following: - We only collect data that is strictly necessary for the management of our services. - We treat personal data confidentially and securely. - Clients have the right to access, rectify, delete, limit the processing, and object to the use of their personal data, as well as to request the portability of the same.
3. **Pre-contractual Information** In accordance with Ley 44/2006, of 29 December, on the Improvement of Consumer and User Protection, we provide all relevant information before the signing of any contract, including details about the property, conditions of sale or rental, and any other pertinent information.
4. **Mediation Contract** According to Ley 29/1994, of 24 November, on Urban Leases (LAU), we formalise a mediation contract with our clients, which clearly establishes our obligations, the conditions of the service, and the applicable fees.
1. **Right to Information** Clients have the right to receive truthful and complete information about the property and the conditions of the contract. According to Article 8 of Ley 34/1988, they must be informed clearly and precisely about all aspects of the transaction.
2. **Right to Data Protection** Under Article 15 of the GDPR and Article 13 of the LOPDGDD, clients have the right to request access, rectification, deletion, and limitation of the processing of their personal data. Additionally, they may request data portability and object to its processing.
3. **Obligation of Truthfulness** Clients must provide truthful and complete information during the purchase, rental, or any other real estate transaction process. Omission or falsification of the information provided could affect the validity of the contract.
4. **Compliance with Contractual Conditions** Once the mediation contract or any other real estate agreement is signed, clients are obliged to comply with the agreed conditions, including the payment of the agreed fees and commissions.
1. **Data Retention** In accordance with Article 5 of the GDPR and Article 32 of the LOPDGDD, personal data is retained only for as long as necessary to fulfil the purposes for which it was collected. Subsequently, it is securely deleted.
2. **Right to Rectification and Deletion** Clients may exercise their right to rectification and deletion of data at any time. We commit to responding to these requests within a maximum period of 30 days, in accordance with Article 12 of the GDPR.
